Terms of Service

1. What NotaryLinx Is

NotaryLinx is a profile page platform. It gives notaries and notary professionals a single, shareable mini website to present their services, service areas, scheduling links, reviews, social media, and contact information in one place.

2. Eligibility and Accounts

• You must be at least 18 years old and able to form a binding contract.
• You must provide accurate, current, and complete registration information and keep it updated.
• You are responsible for safeguarding your password and for all activity under your account. Notify us promptly at info@notarylinx.com of any unauthorized use.
• One account per person or business, unless we agree otherwise in writing.

3. Subscription, Billing, and Cancellation

Plan and pricing

The Notarypreneur Plan is offered at $5.00 per month, or such other price as we publish at the time of your purchase. Prices are in U.S. dollars and exclude any applicable taxes, which you are responsible for paying.

Automatic renewal

Your subscription renews automatically each billing period until cancelled. By subscribing, you authorize us and our payment processor to charge your payment method on a recurring basis. If a payment fails, we may retry the charge and may suspend or downgrade your account until payment is received.

Cancellation

You may cancel at any time from your account settings or by contacting support. Cancellation takes effect at the end of your current billing period. You will retain access until that date, and your page may be unpublished afterward.

Refunds

Except where required by law, fees are non-refundable and we do not provide refunds or credits for partial billing periods, unused time, or downgrades. If we offer a free trial or promotional period, we will state its length and terms at sign-up; unless you cancel before it ends, your paid subscription begins automatically at the then-current price. If you believe you were billed in error, contact us within 30 days of the charge and we will review the matter in good faith.

Price changes

We may change pricing. We will give you at least 30 days' notice before a price change affects your subscription. Continuing to use the Service after the change takes effect means you accept the new price.

4. Your Content

"Your Content" means everything you upload, publish, or display through the Service — text, photos, logos, links, service descriptions, pricing, reviews, and credential information.

Ownership

You retain all ownership rights in Your Content. We claim no ownership of it.

License to us

You grant NotaryLinx a worldwide, non-exclusive, royalty-free license to host, store, reproduce, adapt for formatting, publish, and display Your Content solely for the purpose of operating, providing, securing, and promoting the Service. This license ends when you delete Your Content or close your account, except for copies retained in routine backups or as required by law.

Your representations

You represent and warrant that you own or have all necessary rights to Your Content; that it is accurate and not misleading; and that it does not infringe any third party's intellectual property, privacy, or other rights.

5. Notary-Specific Responsibilities

If you are a notary or notary professional using the Service, you are solely responsible for:

• Holding and maintaining a valid, current commission and any licenses, bonds, or insurance required in your jurisdiction
• Ensuring that every claim on your page — including your title, credentials, certifications, commission status, service areas, and pricing — is accurate and current
• Complying with all laws, regulations, and notary rules that apply to you, including any restrictions on advertising, fees, titles, and unauthorized practice of law
• The performance, quality, and legality of the services you provide to your clients
• Protecting the confidentiality of your clients and their documents

6. Acceptable Use

You agree not to:

• Violate any law or regulation, or use the Service for any unlawful purpose
• Post false, deceptive, or misleading information, including fabricated reviews, credentials, or affiliations
• Impersonate any person or entity, or misrepresent your affiliation with one
• Upload content that is defamatory, harassing, obscene, hateful, or infringing
• Offer or promote services you are not licensed or commissioned to perform
• Provide legal advice or engage in the unauthorized practice of law through your page
• Upload malware or attempt to gain unauthorized access to the Service or other accounts
• Scrape, crawl, or harvest data from the Service without our written permission
• Resell, sublicense, or white-label the Service without our written permission
• Interfere with or disrupt the integrity or performance of the Service

We may investigate and take action — including removing content, suspending, or terminating accounts — for any violation of these Terms.

7. Our Intellectual Property

The Service, including the NotaryLinx name, logo, wordmark, designs, templates, software, and all related content (excluding Your Content), is owned by NotaryLinx and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms. You may not copy, modify, distribute, or create derivative works from the Service except as expressly permitted.

8. Third-Party Services

The Service may link to or integrate with third-party services — scheduling tools, social media platforms, review sites, and payment processors. We do not control and are not responsible for those services, their content, or their terms. Your use of them is governed by their own agreements.

9. Availability and Changes

We work to keep the Service available but do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue any part of the Service at any time. We may perform maintenance that temporarily limits availability. We will make reasonable efforts to notify you of material changes that affect your use.

10. Termination

You may stop using the Service and close your account at any time. We may suspend or terminate your account, with or without notice, if you breach these Terms, if we are required to by law, or if we discontinue the Service. On termination, your right to use the Service ends immediately and your page may be unpublished. Sections that by their nature should survive — including ownership, disclaimers, limitation of liability, indemnification, and dispute resolution — will survive.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICE WILL MEET YOUR REQUIREMENTS OR PRODUCE ANY PARTICULAR BUSINESS RESULT. WE MAKE NO REPRESENTATION OR WARRANTY REGARDING ANY MEMBER, ANY MEMBER'S CREDENTIALS OR SERVICES, OR ANY TRANSACTION BETWEEN A MEMBER AND A CLIENT.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NOTARYLINX AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

13. Indemnification

You agree to indemnify, defend, and hold harmless NotaryLinx and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to: Your Content; your use of the Service; your notarial or professional services; your violation of these Terms; or your violation of any law or third-party right.

14. Dispute Resolution

• Informal resolution first. Before filing any claim, you agree to notify us in writing at info@notarylinx.com and describe the dispute and the relief you are seeking. Both parties agree to attempt in good faith to resolve the matter for at least 30 days after that notice.
• If informal resolution fails. Any dispute not resolved informally will be brought exclusively in the state or federal courts located in the State of New Jersey, and you and NotaryLinx each consent to the personal jurisdiction of those courts.
• Individual claims only. To the fullest extent permitted by law, you and NotaryLinx each agree to bring claims only in an individual capacity, and not as a plaintiff or class member in any class, consolidated, or representative action.
• Time limit. Any claim arising out of or relating to the Service must be filed within one (1) year after the claim arose, except where applicable law requires a longer period.

15. Governing Law

These Terms are governed by the laws of the State of New Jersey, without regard to its conflict of law rules. Subject to Section 14, the state and federal courts located in the State of New Jersey will have exclusive jurisdiction over any dispute.

16. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above and, for material changes, provide additional notice such as email or an in-Service notice. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

17. General

• Entire agreement: these Terms and our Privacy Policy are the entire agreement between you and NotaryLinx regarding the Service.
• Severability: if any provision is held unenforceable, the rest remains in effect.
• No waiver: our failure to enforce a provision is not a waiver of it.
• Assignment: you may not assign these Terms without our written consent; we may assign them in connection with a merger, acquisition, or sale of assets.
• Independent parties: nothing here creates a partnership, joint venture, employment, or agency relationship between you and NotaryLinx.
